Terms of Service

ScaleLeadAI is a software tool that helps you discover, organize, score, and contact potential business leads using publicly available business information and data you provide. The Service surfaces information about businesses; it does not guarantee that any information is accurate, current, or complete.

You must be at least 18 years old and able to form a binding contract to use the Service. You are responsible for the information you provide, for keeping your password secure, and for all activity that occurs under your account. Notify us promptly of any unauthorized use.

You agree not to use the Service to:

• violate any law, regulation, or third-party right;
• send unsolicited bulk messages or any communication that violates anti-spam laws;
• harvest, resell, or redistribute data in a way that violates the terms of the underlying data sources;
• attempt to disrupt, reverse-engineer, or gain unauthorized access to the Service; or
• use the Service to harass, defraud, or harm any person or business.

The Service may help you draft outreach messages, but you decide whether and how to contact anyone. You are solely responsible for ensuring that your communications comply with all applicable laws, including the U.S. CAN-SPAM Act, the Telephone Consumer Protection Act (TCPA), Canada's CASL, and the EU/UK GDPR where relevant. This includes honoring opt-out requests and including required sender information. You are responsible for obtaining any consent required before contacting a business or individual.

Business information is drawn from third-party sources, including OpenStreetMap (© OpenStreetMap contributors, available under the Open Database License) and the Google Places API. Your use of data obtained through the Service is subject to those sources' licenses and terms. Where required, attribution to OpenStreetMap must be preserved. We do not own and do not warrant third-party data.

ScaleLeadAI is offered as a recurring monthly subscription. By starting a subscription you authorize us and our payment processor (Stripe) to charge your payment method, on an automatically recurring monthly basis, the price of the plan you select (currently $39, $49, or $149 per month depending on plan), until you cancel.

Free trial. New customers may be offered a 24-hour free trial, which requires a payment method up front. If you do not cancel before the trial ends, your subscription begins automatically and your payment method is charged the plan price. The free trial is available to new customers only.

How to cancel. You can cancel at any time — including during the free trial — from the "Manage subscription" link on your Billing page, which opens our payment processor's self-service portal. Cancellation is effective at the end of the current billing period; canceling during a free trial stops it before any charge. Cancellation is at least as easy as signing up and can be done online without contacting us.

Renewal & price changes. Your subscription renews automatically each month at the then-current price unless canceled. We may change pricing on a going-forward basis and will provide reasonable advance notice of any change. Except where required by law, fees already paid are non-refundable; if you believe you were charged in error, contact us at ScaleLeadAI.Support@gmail.com and we will review your request.

The Service, including its software, design, and branding, is owned by ScaleLeadAI and protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable right to use the Service in accordance with these Terms. Content you create in the Service (such as notes and tags) remains yours.

The Service is provided "as is" and "as available," without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted or error-free, or that any lead information is accurate, complete, current, or will result in any business outcome. You use the Service and any data it provides at your own risk.

To the maximum extent permitted by law, ScaleLeadAI and Lee Miele will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any lost profits or revenues, arising out of or related to your use of the Service. Our total liability for any claim relating to the Service will not exceed the greater of (a) the amount you paid us in the 12 months before the claim, or (b) US $100.

You agree to indemnify and hold harmless ScaleLeadAI and Lee Miele from any claims, damages, or expenses (including reasonable legal fees) arising from your use of the Service, your outreach activities, or your violation of these Terms or any law.

You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms or if we discontinue the Service. Upon termination, your right to use the Service ends.

We may update these Terms from time to time. If we make material changes, we will update the "Last updated" date above and, where appropriate, notify you. Your continued use of the Service after changes take effect constitutes acceptance.

These Terms are governed by the laws of the United States and the state in which the Company is established, without regard to conflict-of-law principles. Any disputes will be resolved in the courts located there.
